January 18, 2007 AGENDA Agenda for the reorganization and regular meeting of the Planning Board of the Borough of Little Silver to be held on, Thursday, January 18, 2007 at 7:30 P.M. New Business: Request for Administrative Approval MG Kelly Builders, Application of Bradley Olman to demolish a portion of the existing driveway and construct a 21 by 21 one story garage addition and convert the existing garage to storage space on the property at 78 Garden Road, Block 6, Lot 1, in the R-3 Zone which violates the minimum required lot area of 20,000 square feet where 16,653 square feet is existing; the minimum required improved road frontage of 100 feet where 45.72 feet is existing; the minimum required rear yard setback for a principal structure of 50 feet where 21 feet is existing and 9.5 feet is proposed; the minimum required side yard setback for a principal structure of 15 feet on each side where 29.10 feet and 8.3 feet is existing and 12.4 feet and 8.3 feet is proposed; and the maximum allowable structure height of 30 feet and not exceeding 2 ½ stories where 34.5 feet is existing. Application of Robert Wichmann to construct a 30 by 8 one story bathroom, kitchen and family room addition and an 8 by 4 one story window seat addition on the property at 96 Lovett Avenue, Block 52, Lot 6, in the R-3 Zone which violates the minimum required lot area of 20,000 square feet where 11,250 square feet is existing; the minimum required improved road frontage of 100 feet where 75 feet is existing; the minimum required side yard setback for a principal structure of 15 feet on each side where 12.26 feet and 12.92 feet is existing; the maximum allowable lot coverage of 18% where 20% is proposed. Application of David Klein to construct an 18 by 35 in-ground swimming pool, a 22 by 30 two story garage, demolish the existing deck and construct a stone patio, construct a 19 by 8 second story bedroom addition and a 166 by 6 second floor balcony, 12 by 8 and 13 by 8 covered front porches, brick paver driveway addition, 18 by 14 addition of paver area at the front of the house, install pool equipment, a paver patio in the rear, a hot tub, an outdoor fireplace and 4 high closed fencing on the property at 611 Little Silver Point Road, Block 62, Lot 24, in the R-1 Zone which violates the minimum required lot area of 60,000 square feet where 25,977.85 feet is existing; the minimum required improved lot frontage of 160 feet where 100 feet is existing; the minimum side yard setback for a principal building 31 feet in height of 40 feet on each side where 15 feet and 19.9 feet is existing; the maximum impervious surface allowed of 25% where 24% is existing and 38% is proposed; accessory buildings shall be located in other than a front yard where a 598 square foot garage is proposed within the front yard, 34.2 feet from the front property line; accessory buildings may occupy not more than 25% of the rear or side yard in any zone provided that such buildings shall not exceed 16 feet in height where a 22.5 foot high garage is proposed; a closed fence located in a front yard and within 50 feet of any body of water shall not exceed 36 inches in height where 4 foot high fencing is existing within the front yard and 13 feet from a body of water and is proposed to be modified; an outdoor swimming pool shall be located not less than 25 feet from the side or rear of the residence where 23 feet is proposed; pool equipment shall be located not less than 20 feet from any side or rear property line where 3 feet is proposed from the easterly property line. CAFRA approval is required. Application of Anthony and Catherine Filippelli to demolish the existing second floor and construct a 31 by 28 second floor addition consisting of a master bedroom and bath, two bedrooms, computer room/office and second story terrace, a 4 by 15 front porch addition and interior renovations on the property at 59 Salem Lane, Block 28, Lot 115, in the R-3 Zone which violates the minimum required lot area of 20,000 square feet where 6,343 square feet is existing; the minimum required improved road frontage of 100 feet where 59.66 feet is existing; the minimum required front yard setback of 30 feet where 21 feet is existing and 20 feet is proposed; the minimum required rear yard setback for a principal structure of 50 feet where 30 feet is existing; the minimum required side yard setback for a principal structure of 15 feet on each side where 6.6 feet and 9.6 feet is existing; the maximum allowable lot coverage of 18% where 23% is existing and 25% is proposed. Note: The coverage provided on the Architectural plan does not appear to include the existing decking. All ground coverage must be taken into account for lot coverage (all structures) and impervious coverage (walkways, driveway, pavers, etc.) 8. Resolutions: Major Subdivision Application of Martelli Development for Application of Michael Wilson to demolish the existing structure and construct a 63 by 57 two story single family structure with 12 by 23 deck on the property at 41 Bernard Terrace, Block 68, Lot 12, in the R-2 Zone which violates the minimum required lot area of 25,000 square feet where 20,000 square feet is existing. Application of Jeffrey and Aimee Langa to demolish the existing 272 square foot patio and replace it with a paver patio approximately 333 square feet in size, construct a 4 by 1910 two story kitchen addition with 2 by 10 bay window and a 244 by 465 second floor addition consisting of four bedrooms, a bathroom and laundry room on the property at 75 North Sunnycrest Drive, Block 32, Lot 6, in the R-3 Zone which violates the minimum required lot area of 20,000 square feet where 7,000 square feet is existing; the minimum required improved road frontage of 100 feet where 70 feet is existing; the minimum required front yard setback of 30 feet where 23 feet is existing; the minimum required rear yard setback for a principal structure of 50 feet where 35 feet is existing and 33 feet is proposed; the minimum required side yard setback for a principal structure of 15 feet on each side where 10.8 feet and 5 feet is existing; the minimum required side yard setback for an accessory structure (patio) of 15 feet on each side where approximately .04 feet is existing and proposed on the westerly property line; the maximum allowable lot coverage of 18% where 19% is existing and 22.4% is proposed. Application of Catherine Bitsack, Chocolat Bebe to install a 4 by 3.5 (14 square foot) wall sign on a building other than where the business is located on the property at 469 Prospect Avenue, Block 38, Lot 13, in the B-1 Zone which violates Section 8.26.E.1: Each non-residential use may have a wall sign on the front of the building where an additional sign is proposed on a building other than where the business is located. Application of Joseph Pia to construct a 20 by 34 in-ground swimming pool and spa with 542 square feet of patio on the property at 27 Holly Tree Lane, Block 46, Lot 63, in the R-1A Zone which violates the minimum required improved road frontage of 150 feet where 100 feet is existing; the minimum required side yard setback for an accessory structure 96 square feet in size is 8 feet on each side where 3.3 feet is existing on the easterly property line; an outdoor private swimming pool shall be located not less than 25 feet from the side or rear of the residence where 11 feet is proposed. 9.
